Mike Defensor Pleads Not Guilty in Alleged ₱75-M Plunder Case; Marcoleta's Arraignment Deferred
Former Anakalusugan Party-list Representative Mike Defensor pleaded not guilty before the Sandiganbayan Third Division on Wednesday to a plunder charge stemming from allegations that he participated in providing funds allegedly intended for the 2025 Senate campaign of Sen. Rodante Marcoleta.
Businessmen Joseph Varias Espiritu and Aristotle Baluyut Viray, who were charged alongside Defensor, also entered not guilty pleas during the arraignment.
According to the Office of the Ombudsman, Defensor allegedly contributed ₱30 million, Espiritu ₱25 million, and Viray ₱20 million on separate occasions in January 2025.
The Ombudsman alleged that Senator Marcoleta failed to declare the supposed campaign contributions in both his Statement of Contributions and Expenditures (SOCE) and his Statement of Assets, Liabilities and Net Worth (SALN). Prosecutors argue that the alleged acceptance and non-disclosure of the funds constitute unjust enrichment, forming the basis of the plunder charge.
The Ombudsman also filed three related counts under Presidential Decree No. 46, which prohibits public officials from receiving gifts connected with their office and penalizes private individuals who offer such gifts.
Marcoleta's Arraignment Postponed
Unlike his co-accused, Senator Marcoleta was not arraigned during Wednesday's proceedings.
The Sandiganbayan deferred his arraignment while it considers his motion to quash, which seeks the dismissal of the charges before he is required to enter a plea.
The court stated that it would first resolve the motion before setting further hearings on Marcoleta's petition for bail.
Medical Findings Presented Before the Court
The Sandiganbayan also addressed Marcoleta's medical condition during the proceedings.
Following his arrest, Marcoleta had been confined at the PNP General Hospital, where he was reportedly diagnosed with mild pneumonia and degenerative disc disease.
However, Philippine General Hospital Director Dr. Gerardo Legaspi informed the court that the medical team unanimously found no condition requiring continued hospitalization.
Based on those findings, the court ordered Marcoleta's transfer to the Quezon City Jail Male Dormitory in Payatas while legal proceedings continue.
Defense Maintains Charges Are Politically Motivated
The accused have consistently denied the allegations and maintain their innocence.
Defensor questioned why he and his co-accused were detained ahead of individuals he described as the alleged principal figures behind corruption, specifically mentioning Martin Romualdez and Zaldy Co.
Those statements reflect Defensor's defense and have not been established as findings of fact by the court.
The legal proceedings remain ongoing, and the Sandiganbayan has yet to rule on the merits of the charges.
🎙️ Reportorial Commentary
The arraignment marks another step in what is expected to be a closely watched legal proceeding.
At this stage, it is important to distinguish between criminal allegations and judicial findings. A plea of "not guilty" formally places the burden on prosecutors to present evidence supporting every element of the charges beyond the legal standards required by the court.
Likewise, Senator Marcoleta's pending motion to quash means the court must first determine whether the criminal information is legally sufficient before requiring him to answer the allegations.
As the case progresses, future court rulings—not public opinion—will determine whether the prosecution's evidence supports the charges or whether the accused should be acquitted.
The proceedings also underscore the broader importance of transparency in campaign finance reporting and public accountability. Regardless of political affiliation, the legal process is designed to allow both the prosecution and the defense to present their evidence before an independent court reaches a decision.
📖 Bible Reflection (Exegesis)
"Do not judge by appearances, but judge with right judgment." — John 7:24 (ESV)
Jesus' instruction reminds believers that justice requires more than assumptions or emotional reactions. True judgment depends on careful examination of facts, evidence, and fairness.
In legal matters, this principle encourages patience while due process unfolds. Courts exist to weigh evidence impartially, and Christians are called to value both truth and justice rather than rushing to conclusions based solely on accusations or public sentiment.
Whether one is accused or accuser, integrity is best demonstrated by allowing truth to emerge through honest examination.
Remulla at Asawa ni Cabral, Magkaiba ang Sinasabi: Nasaan ang mga Gadget at Cellphone?
December 22, 2025•2 min read

“We’re asking it from the family kasi kinuha nila… the cellphone will be analyzed later… pati access sa laptop, but subject to subpoena ng Sandiganbayan, Ombudsman, o NBI.”
✔️ May cellphone
✔️ May laptop
✔️ Nasa pamilya
Dalawang Salaysay, Isang Tanong
Chain of Custody: Nasaan ang Butas?
At mas mahalaga:
